Governor Brown Signs Far-Reaching Anti-Gun Law

Unless you are an insurance adjuster or broker, person engaged solely in the business of securing information about persons or property from public records, a secured creditor engaged in repossession, security guard, movie maker, attorney, banker, collections agent, or other "specially" and specifically designated persons you will no longer be allowed to carry an UNLOADED and UNCONCEALED firearm.

AB 144 was signed into law over the weekend and takes affect January 1, 2012.  The law is convoluted and misguided with countless exceptions having little rhyme or reason. 

There is an exemption granted to "savings association" and another for persons engaged in or attempting to make a lawful arrest.  That's right, you can have a completely useless unloaded gun if you are attempting to lawfully arrest someone or if you are somehow a savings association.

This new infringement on our the 2nd Amendment is in response to concerns from several police chiefs and sheriffs around California. 

According to the L.A. Times, LAPD Chief Charlie Beck says officers waste time responding to calls about people with guns who are otherwise being lawful.  It seems that officers and the public have a hard time distinguishing the difference between criminal and non-criminal activities.

Under AB 144 what use to be harmless and lawful is at least a misdemeanor and probably a felony.

Brian Malte, director of state legislation for the Brady Campaign to Prevent Gun Violence, told the L.A. Times "California families will now be able to take their families to the park or out to eat without the worry of getting shot by some untrained, unscreened, self-appointed vigilante." 

But wait.  This law only concerns possession of an UNLOADED gun.  How does Malte make the jump from a unloaded guns to loaded guns??  It was already a crime to exercise vigilante justice as well as negligently discharge a firearm in a public place.  Now, no UNLOADED guns will be discharged??  What is Malte and his fascist Brady brats smoking??

Let's recap.  Brown has just criminalized something that cannot by its own definition hurt anyone- carrying an UNCONCEALED and UNLOADED gun.

"The bottom line is the streets will be safer for law enforcement and families," said the bill's author, Assemblyman Anthony Portantino (D-La Canada Flintridge). "California is no longer the wild west, where citizens had to carry six-shooters on their hips for protection." 

Someone needs to tell Portantino that those six-shooters he is referring to are UNLOADED and completely inert.

The argument for passing AB 144 is completely baseless and does NOTHING to make California safer.  Some people just don't get it.

Out of Control Gun Control, Part 3

Over the weekend, the Mexican attorney general stated: "The controlled trafficking of weapons is not authorized under the Mexican national legislation. An operation that would contemplate this would not have been acceptable to the Mexican government, and it will never be under any circumstance." The Mexican Attorney General also stated that it's conducting its own investigation to identify "the crimes that could have been carried out on Mexican territory."
You know our country is in bad shape when we need the Attorney General of MEXICO to help us get to the bottom of our own governments' corruption.

I would imagine if there were tons of contraband crossing into the U.S. everyday, our own U.S. Attorney General, Eric Holder, would be equally outraged...but he isn't.

Out of Control Gun Control, Part 2

As I indicated HERE, the White House is looking more culpable by the day as being the source of the directives that caused ATF field agents to NOT get involved in an international gun-running operation by Mexican drug cartels. 

As CBS News and other media look into this further, I think we will see that people close to the President knew about the ATF operations and gave direct orders for the ATF to NOT intervene.  More than likely, the Justice Department and White House will become overtly defensive and even more secretive.  This will raise additional awareness from Congress.  Then, under pressure from the Republican-lead Congress, White House staffers and advisers will begin to waffle on their lack of knowledge of the operation. 

The scandal will likely be subdued with the resignation of a few top officials who decide to "move on" to lecture or teach.  (Watch out Harvard; here come the White House washouts!)

Time will tell if the effort by the United States Government to flood the Mexican drug cartels with U.S.-sold guns will have any affect on the 2nd Amendment. 

Whatever happens will likely not include the apprehension and bringing to justice of those on both sides of the border who were complicit in the gun running. 

It makes you wonder why our own government would want ATF to stand-down.  Was the reason, as I suggested, to flood the cartels with guns in hopes of making it look as though the United States has weak gun control laws that need to be beefed up?  Or could it be that there is something even more sinister at work, such as bribery at the highest levels of our government?  I can only speculate...

Out of Control Gun Control


According to various media including CBS, the ATF allowed guns to be purchased in the U.S. by know drug cartel members and transported into Mexico. 

ATF field agents notified superiors of what was happening and were told to stand down.

This “stand-down” policy contributed heavily to the problem of U.S. guns in the hands of the drug cartels, the main reason cited by the Whitehouse for seeking to revise gun control laws.
In essence you have a White House initiative or agenda to disarm a nation and when more data is needed to support an otherwise baseless claim, you order law enforcement to stand-down from doing their job so that a new problem can blossom. 

Ok, maybe it isn’t quite so cut and dry.  Maybe President Obama didn’t tell Napolitano to tell her agents to stand-down.  But even absent a smoking gun (yes, a lame pun), it certainly calls into question the operational policies of our federal law enforcement agencies. 

The federal law enforcement and investigative agents I have known over the years have all been committed to protecting the U.S.  They have all been well trained and educated.  The last thing field agents need is for management to handcuff (yes, another lame pun) their enforcement duties.  If management feels a law is unenforceable, seek to have the law amended or abolished.

As liberal gun control advocates seek to disarm lawful U.S. citizens by creating new laws that are even more restrictive, we must recognize that current laws are under enforced at all levels. 

Until current gun control laws are fully and fairly enforced by field agents with the support of their respective supervisors and prosecutors, the legislature and White House should steer clear of proposing new restrictions that will soon fail from lack of enforcement.

OC Register Sides With Gun Owners


"Self-defense is a basic right, recognized by many legal systems from ancient times to the present day," wrote Justice Samuel Alito, who was joined in the majority by Chief Justice John Roberts and Justices Anthony Kennedy, Antonin Scalia and Clarence Thomas. (from the OCR)
The big question on my mind is this:  Is the right to keep and bear arms in the name of self-defense only a right of someone occupying a residence?  What about the "houseless" (a term my brother likes to use and rightfully so)?  What about business owners and workers?  Do you have to have a structure in which you you live, pay rent, or own in order to defend your self with a firearm?  I think not.

Based on the Court's ruling, I think the right to self-defense is not limited to the domicile but rather anywhere a person is.  The only exceptions that I could foresee might include public schools and buildings such as City Hall, where there is a police presence and command of security to defend the defenseless. 

The real question...when will California recognize the U.S. Constitution?

The statistics, contained in the department's fiscal 2005 budget performance report, show that the average response time for the highest-priority calls -- Priority 1 -- was 8 minutes, 25 seconds in fiscal 2003, up from 7 minutes, 19 seconds in fiscal 2002 and 7 minutes, 47 seconds in fiscal 2001.”


Imagine struggling with a carjacker armed with a knife and high on meth. He is trying to take your car and in the back seat is your sleeping infant.

FOR STARTERS, GRANDMA WAS BORN TUESDAY, DECEMBER 22, 1914 IN HER FAMILY'S ATWOOD RANCH HOUSE.



IT IS WORTH NOTING THOSE ALSO BORN IN 1914:

JACK LALANNE

JOE DIMAGGIO

DANNY THOMAS



AND WHO DIED IN 1914:

JOHN MUIR, THE FAMOUS NATURALIST FOR WHICH NUMEROUS ROADS, PARKS, HOTELS, AND NATURE RESERVES ARE NAMED.



IT IS ALSO WORTH NOTING THAT IN 1914 WOODROW WILSON SIGNS MOTHER'S DAY PROCLAMATION AND BABE RUTH MAKES HIS MAJOR LEAGUE DEBUT WITH THE RED SOX. MOTHER'S DAY AND BASEBALL- TWO OF MY FAVORITES!! (PERHAPS HER NICKNAME "BABE" CAME FROM BABE RUTH???)



GRANDMA WAS BORN INTO A PERIOD OF TIME FILLED WITH TURMOIL. IN JUNE OF 1914 ARCHDUKE FRANZS FERDINAND WAS ASSASSINATED. WITHIN ONE MONTH WORLD WAR I RAGED ACROSS EUROPE. TWO DAYS AFTER HER BIRTH HOWEVER, GERMAN AND BRITISH TROOPS INTERRUPTED WWI TO CELEBRATE CHRISTMAS. (PERHAPS THEY PAUSE KNOWING THAT A GREAT WOMAN WAS BORNE) WORLD WAR I CONTINUED UNTIL THE TREATY OF VERSAILLES IN 1919.



ALTHOUGH SHE WAS ONLY 5 YEARS OLD, SHE SAW THE LEAGUE OF NATIONS CREATED AND THE 19TH AMENDMENT WAS APPROVED BY THE U.S. CONGRESS GUARANTEEING THE RIGHTS OF WOMEN TO VOTE.



SHE LIVED THROUGH MANY NOTABLE EVENTS. LIKE THE 1933 LONG BEACH EARTHQUAKE OR WHEN ATWOOD FLOODED ALONG WITH MOST OF ORANGE COUNTY IN 1938 AND THE FLOOD-WATERS CLAIMED MORE THAN 50 PEOPLE, 43 OF WHICH WERE FROM ATWOOD! ALL OF THIS DURING A TIME THAT WE READ ABOUT IN SCHOOL AND KNOWN AS "THE GREAT DEPRESSION". SOMEWHERE IN ALL OF THAT SHE FOUND THE LOVE OF HER LIFE, GRANDPA LEO, GRADUATED HIGH SCHOOL, GOT MARRIED, AND HAD KIDS!



THEN THERE WAS WORLD WAR II. FROM PEARL HARBOR TO HIROSHIMA, GRANDMA WAS RAISING MY UNCLE BOB AND MOM ARLINE. WITH AIR-RAID SIRENS AND BLACKOUTS SHE WAS A WIFE AND MOTHER. WHAT A TIME TO RAISE CHILDREN! I BET GRANDMA'S PARENTS WERE ABEL TO TELL HER A THING OR TWO ABOUT RAISING KIDS IN WARTIME.



GRANDMA WAS THERE WHEN THE BOY SCOUTS OF AMERICA HELD THEIR 3RD ANNUAL NATIONAL JAMBOREE IN 1953. SHE SAW AIRBASES OPEN IN '42 AND CLOSE IN '99. SHE WATCHED WALTER KNOTT START UP HIS BERRY FARM AND WALT DISNEY TURN ORANGE GROVES AND STRAWBERRY PATCHES INTO DISNEYLAND!



SHE SAW THE HORSE AND CARRIAGE FADE AWAY INTO HISTORY AND SPACE TRAVEL EXPLODE BEFORE HER WITH THE FIRST LUNAR LANDING. JUST IMAGINE HOW MUCH TECHNOLOGY HAS CHANGED OVER THE LAST 100 YEARS. FROM TUBE RECTIFIERS TO SUPERCONDUCTORS; FROM TRANS-ATLANTIC TELEGRAPH CABLES TO SATELLITE TV.



SHE SAW MORE IN HER 93 YEARS THAN MOST OF US WILL EVER READ ABOUT, LET ALONE LIVE THROUGH!



OF THOSE 93 YEARS IT IS MY HONOR TO HAVE BEEN HER GRANDSON FOR 35 OF THEM. SHE WAS MY MOTHER WHEN MOM HAD TO WORK. SHE WIPED MY NOSE AND PUT FOOD IN MY MOUTH. SHE LET ME PLAY WITH GRANDPA EVEN THOUGH SHE NEEDED HIM TO TAKE HER TO THE STORE. SHE WAS MY GRANDMA AND I WILL MISS HER IMMENSELY.



JUST LOOK AROUND THIS ROOM; SHE DID THIS. SHE IS RESPONSIBLE FOR BRINGING SO MANY GOOD PEOPLE INTO THIS WORLD AND TOGETHER TODAY. THIS IS HER LEGACY.
