The Case for Profiling

By Robert W. Poole, Jr.
Director of Transportation Studies
Reason Foundation

In recent years when discussing a risk-based airport screening system, I have avoided using the word profiling, even though it’s a legitimate concept. Since most people hear the word “profiling” and immediately think “racial,” “ethnic,” or “religious,” I decided that the term itself confused more than it clarified.

But recent online discussions, including an attack on me by two writers for The Nation as a “high-profile charlatan pushing racial profiling as the alternative to TSA pat-downs and body scans,” has led me to change my mind. In a blog post last week for Reason magazine’s “Hit & Run” blog, I explained the legitimate meaning of evidence-based profiling, both positive and negative. (http://reason .com/blog/2010/12/10/the-case -for -profiling-air-tra)

Rather than repeat that argument here (please read the blog post), I’d like to elaborate a bit on how I envision negative profiling (i.e., identifying the high-risk category of travelers) would work. The idea would be to make full use of the various databases the government already maintains, using various intelligence sources, to assign more people to the “selectee” category for which secondary screening is mandatory. Only high-risk travelers, so defined, would be required to face body scans or intrusive pat-downs. Stewart Baker, a former DHS official, points out in National Review (Dec. 20, 2010) that the TSA’s sister agency, Customs & Border Protection, “knows a lot about [people’s] travel plans and uses a database ten or twenty times larger than the selectee list to decide who will be screened closely. And yet for 99 travelers out of 100, border screening is far less hassle—and far less of a privacy invasion—than air security.

The original anti-skyjacking system developed by an FAA task force in 1969-70 used a characteristics-based profile that was not challenged by the ACLU and was ruled constitutional by a New York Federal court. It included 23 elements, of which only half of one percent of air travelers met as many as six, according to David Brown, one of the task force’s members. But according to Brown, all 19 of the 9/11 hijackers would have been flagged by that system—had it still been in use in 2001.
Shifting aviation security from looking for dangerous objects to looking for dangerous people should be high on the agenda of the new Congress.

Two CBS News Polls Show Conflicting Sentiments On the Use of Airport Body Scanners

According to a CBSNews.com story, "a new CBS News Poll released Monday found 81 percent of Americans think airports should use these new machines -- including a majority of both men and women, Americans of all age groups, and Democrats, Republicans, and independents alike. Fifteen percent said airports should not use them."

However, contained within the story is a simple online poll which readers can take.  That poll shows something quite different.

So what gives?  Why does one CBS poll say 81% of Americans think airports should use body scanners while another CBS poll shows 80% of the online readers the scans and pat downs are an invasion of their civil liberties?  Are online readers that far out of touch with those who responded to the first CBS News poll?  We may never know.

These conflicting results from the same news agency should raise a few eyebrows about polling practices, questions, and data compilation.

L.A. airport police advocate authorizing all law enforcement officers to carry firearms aboard domestic flights

LOS ANGELES - February 8, 2010 –
The nation's largest airport police association today advocated authorizing all law enforcement officers to carry firearms aboard domestic airline flights. Marshall McClain, president of the Los Angeles Airport Peace Officers Association (LAAPOA), said the program proposed to the Obama Administration by the Federal Law Enforcement Officers Association (FLEOA) is warranted in light of the recent attempt to detonate an explosive device aboard Northwest Airlines Flight 253 on Christmas Day and recent intelligence that Al-Qaeda is likely to attempt a terrorist attack in the U.S. within the next six months.

"We believe that additional armed, trained law enforcement personnel aboard aircraft is a prudent measure to be taken at this time," said McClain. "We join FLEOA in urging President Obama to issue an Executive Order to authorize all law enforcement officers, active and retired, and certified by the Law Enforcement Officers Safety Act (LEOSA), to carry firearms aboard domestic flights as an added line of defense against terrorists."

The LEOSA of 2004 authorizes all law enforcement officers, active and retired, to carry firearms anywhere in the country, at any time, as long as they meet the criteria set forth in the act and qualify with their firearm on an annual basis. But they are only allowed to carry them aboard commercial airlines when traveling on official business and authorized by their department. The FLEOA maintains that all law enforcement officers who are LEOSA certified, and possess an annual medical clearance, are valuable assets that should be used to augment domestic flight coverage provided by federal air marshals.

FLEOA asked the President to direct the Federal Aviation Administration and the Transportation Security Administration to comply with an Executive Order authorizing LEOSA-certified law enforcement officers to fly armed. FLEOA believes that the Federal Air Marshal Service has the ability to coordinate this effort and this action is necessary at this time as an additional layer of security to safeguard the flying public.

About the Los Angeles Airport Peace Officers Association:
The Los Angeles Airport Peace Officers Association represents more than 425 sworn police officers and firefighters of the Los Angeles Airport Police Department assigned to protect and serve Los Angeles International Airport (LAX), LA/Ontario International Airport (ONT) and Van Nuys Airport (VNY). Its Mission is to maintain a leadership role in organizing, empowering and representing the interests of all current and retired members.

NOTE: This story was first reported on KFI AM640 by Steven Gregory who provided me with the link to this press release. After reading it, I can't help but wonder why any citizen couldn't carry a firearm on board a domestic flight if they have received proper firearm training. Why restrict it only to law enforcement? If an officer wants to know how it feels to be a typical California citizen, just leave your gun at home.

My Grandma - A Eulogy

LET'S TALK ABOUT 1914 FOR A MOMENT.

FOR STARTERS, GRANDMA WAS BORN TUESDAY, DECEMBER 22, 1914 IN HER FAMILY'S ATWOOD RANCH HOUSE.

IT IS WORTH NOTING THOSE ALSO BORN IN 1914:

JACK LALANNE

JOE DIMAGGIO

DANNY THOMAS

AND WHO DIED IN 1914:

JOHN MUIR, THE FAMOUS NATURALIST FOR WHICH NUMEROUS ROADS, PARKS, HOTELS, AND NATURE RESERVES ARE NAMED.

IT IS ALSO WORTH NOTING THAT IN 1914 WOODROW WILSON SIGNS MOTHER'S DAY PROCLAMATION AND BABE RUTH MAKES HIS MAJOR LEAGUE DEBUT WITH THE RED SOX. MOTHER'S DAY AND BASEBALL- TWO OF MY FAVORITES!! (PERHAPS HER NICKNAME "BABE" CAME FROM BABE RUTH???)

GRANDMA WAS BORN INTO A PERIOD OF TIME FILLED WITH TURMOIL. IN JUNE OF 1914 ARCHDUKE FRANZS FERDINAND WAS ASSASSINATED. WITHIN ONE MONTH WORLD WAR I RAGED ACROSS EUROPE. TWO DAYS AFTER HER BIRTH HOWEVER, GERMAN AND BRITISH TROOPS INTERRUPTED WWI TO CELEBRATE CHRISTMAS. (PERHAPS THEY PAUSE KNOWING THAT A GREAT WOMAN WAS BORNE) WORLD WAR I CONTINUED UNTIL THE TREATY OF VERSAILLES IN 1919.

ALTHOUGH SHE WAS ONLY 5 YEARS OLD, SHE SAW THE LEAGUE OF NATIONS CREATED AND THE 19TH AMENDMENT WAS APPROVED BY THE U.S. CONGRESS GUARANTEEING THE RIGHTS OF WOMEN TO VOTE.

SHE LIVED THROUGH MANY NOTABLE EVENTS. LIKE THE 1933 LONG BEACH EARTHQUAKE OR WHEN ATWOOD FLOODED ALONG WITH MOST OF ORANGE COUNTY IN 1938 AND THE FLOOD-WATERS CLAIMED MORE THAN 50 PEOPLE, 43 OF WHICH WERE FROM ATWOOD! ALL OF THIS DURING A TIME THAT WE READ ABOUT IN SCHOOL AND KNOWN AS "THE GREAT DEPRESSION". SOMEWHERE IN ALL OF THAT SHE FOUND THE LOVE OF HER LIFE, GRANDPA LEO, GRADUATED HIGH SCHOOL, GOT MARRIED, AND HAD KIDS!

THEN THERE WAS WORLD WAR II. FROM PEARL HARBOR TO HIROSHIMA, GRANDMA WAS RAISING MY UNCLE BOB AND MOM ARLINE. WITH AIR-RAID SIRENS AND BLACKOUTS SHE WAS A WIFE AND MOTHER. WHAT A TIME TO RAISE CHILDREN! I BET GRANDMA'S PARENTS WERE ABEL TO TELL HER A THING OR TWO ABOUT RAISING KIDS IN WARTIME.

GRANDMA WAS THERE WHEN THE BOY SCOUTS OF AMERICA HELD THEIR 3RD ANNUAL NATIONAL JAMBOREE IN 1953. SHE SAW AIRBASES OPEN IN '42 AND CLOSE IN '99. SHE WATCHED WALTER KNOTT START UP HIS BERRY FARM AND WALT DISNEY TURN ORANGE GROVES AND STRAWBERRY PATCHES INTO DISNEYLAND!

SHE SAW THE HORSE AND CARRIAGE FADE AWAY INTO HISTORY AND SPACE TRAVEL EXPLODE BEFORE HER WITH THE FIRST LUNAR LANDING. JUST IMAGINE HOW MUCH TECHNOLOGY HAS CHANGED OVER THE LAST 100 YEARS. FROM TUBE RECTIFIERS TO SUPERCONDUCTORS; FROM TRANS-ATLANTIC TELEGRAPH CABLES TO SATELLITE TV.

SHE SAW MORE IN HER 93 YEARS THAN MOST OF US WILL EVER READ ABOUT, LET ALONE LIVE THROUGH!

OF THOSE 93 YEARS IT IS MY HONOR TO HAVE BEEN HER GRANDSON FOR 35 OF THEM. SHE WAS MY MOTHER WHEN MOM HAD TO WORK. SHE WIPED MY NOSE AND PUT FOOD IN MY MOUTH. SHE LET ME PLAY WITH GRANDPA EVEN THOUGH SHE NEEDED HIM TO TAKE HER TO THE STORE. SHE WAS MY GRANDMA AND I WILL MISS HER IMMENSELY.

JUST LOOK AROUND THIS ROOM; SHE DID THIS. SHE IS RESPONSIBLE FOR BRINGING SO MANY GOOD PEOPLE INTO THIS WORLD AND TOGETHER TODAY. THIS IS HER LEGACY.

A Dedication To My Loving Wife, Stacey. Thank you for all you do for me!

Brad Paisley - I Thought I Loved You Then

I remember trying not to stare the night that I first met you
You had me mesmerized
3 weeks later in the front porch light taking 45 min to kiss you goodnight
I hadn’t told you yet but I thought I loved you then

Chorus
Now you’re my whole life now you’re my whole world
I just can’t believe the way I feel about you girl
Like a river meets the sea
Stronger than it’s ever been
We’ve come so far since that day
And I thought I loved you then.

I remember taking you back to right where I first met you
You were so surprised
There were people around
But I didn’t care I got down on one knee right there
And once again I thought I loved you then

Chorus
Now you’re my whole life now you’re my whole world
I just can’t believe the way I feel about you girl
Like a river meets the sea
Stronger than it’s ever been
We’ve come so far since that day
And I thought I loved you then.

I can just see you with a baby on the way
I can just see you when your hair is turning gray
What I can’t see is how I’m ever gonna love you more
But I’ve said that before.

Now you’re my whole life now you’re my whole world
I just can’t believe the way I feel about you girl
Well look back some day at this moment that we’re in
And I'll look at you and say I thought I loved you then
And I thought I loved you then...
